Do you guys have employment tribunals over there? In the UK this is 100% a worker’s rights violation and you’d able to make your case to the tribunal and get the pay + potentially compensation. Idk how anything works over there though hope there’s something that can be done
No we don't and because the company was so small there isnt a union to talk to either. Only thing I can do is report him to the IRS for Child Labor Law violations and maybe get the pay
They can hold your pay check if you have anything that belongs to the company. Uniforms, tools, equipment etc. Other wise they are obligated to pay you for work done. If you're paid once a month they can hold it up to a month. Sorry to hear, best of luck to you belac!
AFAIK (again only going off my knowledge of UK/European employment law) company size shouldn’t matter in a union’s decision to advise and defend you? For your next job maybe join one ASAP to prevent this situation from happening again at least.
#IANAL: You're entitled to the wages you've earned up to the point of termination. State laws vary on when they can provide the final paycheck (some say on termination, others give the employer till the next paycheck or 30 days), but they must give you what you earned. So you'll want to check into that.
If they straight refuse to and miss the state mandated deadline, there are options (including filing a complaint with the Department of Labor) but you should consider speaking to an attorney if you look into pursuing it further at that point.
